Sign the waiver

Every person who trains at Chano Boxing signs this once. It takes two minutes. Read it — it is short on purpose, and it says exactly what boxing can do to a body.

The agreement

1. What this document is

This is a legal agreement between you and Chano Boxing (the "Gym"), with locations at 701 Sixth Ave, San Diego, CA 92101 and 2110 El Cajon Blvd, San Diego, CA 92104. By signing it you agree to take part in the Gym's activities knowing their risks, and you give up certain legal rights. Read all of it. If anything is unclear, ask before you sign.

2. Acknowledgement of the risks of boxing

Boxing, muay thai and combat training are CONTACT, HIGH-IMPACT activities. They are not a fitness class. I understand and accept that there is a risk of serious or permanent injury, and even death, including but not limited to:

  • Blows taken to the head, face and body.
  • Concussion, traumatic brain injury, and the cumulative effects of repeated blows to the head, whose symptoms may appear days or years later.
  • Broken nose, jaw, hands, wrists, ribs and other bones.
  • Cuts, open wounds, bleeding, bruising and swelling.
  • Eye injuries, including retinal detachment and loss of vision.
  • Dental damage: chipped, loosened or lost teeth.
  • Sprains, muscle tears, ligament injuries, tendinitis, and back, shoulder and knee injuries.
  • Overexertion, dehydration, heat illness, fainting, nausea and exhaustion.
  • Cardiac events, including arrhythmia, heart attack or cardiac arrest, brought on or revealed by intense physical exertion.
  • Contact with Gym equipment: speed bags, heavy bags, double-end bags, pads, weights, ropes, the ring, the ring ropes, the canvas, the posts and the floor.
  • Contact with other people: training partners, coaches and, if I opt in separately, contact during SPARRING.
  • Slips and falls on surfaces made wet by sweat.
  • Skin infections and other communicable illness transmitted through contact with people, equipment or shared surfaces.

I understand these risks exist even when the Gym, its coaches and its staff use reasonable care, and that no instruction, protective gear or supervision removes them.

3. RELEASE OF LIABILITY

In exchange for being allowed to take part, on behalf of myself, my heirs and anyone who could claim through me, I RELEASE, DISCHARGE AND AGREE NOT TO SUE Chano Boxing, its owners, partners, coaches, employees, volunteers, landlords and other members, for any claim, demand, damage or expense arising out of my participation in the Gym's activities, INCLUDING CLAIMS CAUSED BY THEIR OWN ORDINARY NEGLIGENCE.

I understand I am giving up important legal rights, including the right to sue for injuries caused by ordinary negligence.

4. What this document does NOT cover

This release does NOT cover GROSS NEGLIGENCE, or intentional, reckless or fraudulent conduct, or any liability that California law does not allow to be waived. In California a release cannot excuse anyone from gross negligence: the California Supreme Court so held in City of Santa Barbara v. Superior Court (2007) 41 Cal.4th 747. If a court finds that any part of this document tries to do that, that part is struck and the rest of the agreement stands.

5. Voluntary assumption of risk

I take part of my own free will. No one is forcing me. I know the risks described above and I FREELY AND VOLUNTARILY ASSUME them, both the known ones and those that cannot be foreseen.

6. Physical fitness and medical care

I state that I am physically able to do intense, contact exercise and that I have no medical condition that prevents it, or that if I do, I have already discussed it with a doctor and been cleared to train. I agree to tell my coach about any injury, pregnancy, recent surgery, medication or condition that could affect me, and to stop if something hurts.

I authorize the Gym to obtain emergency medical care for me if needed, and I understand that the cost of that care is mine and my health insurer's. The Gym does not provide health insurance or medical expense coverage for its members.

7. Indemnification

I agree to defend and indemnify the Gym against any third-party claim arising out of my own conduct, including injuries I cause to another person inside the Gym.

8. Gym rules

I agree to follow the Gym's rules and the coaches' instructions, to wear the protective gear I am told to wear, not to train under the influence of alcohol or drugs, and to treat other people with respect. The Gym may end my membership if I do not.

9. Sparring and contact

Sparring and contact training are OPTIONAL and require my separate consent, checked separately on this form. If I do not check it, I train without contact. If I do check it, I understand that the risk of blows to the head, concussion and injury increases significantly, and that I may withdraw that consent at any time by telling my coach.

10. Participants under 18

If the participant is under 18, this document must be signed by a parent or legal guardian. The parent or guardian states that they have legal authority over the minor, accepts everything above on the minor's behalf, and further agrees to DEFEND AND INDEMNIFY the Gym against any claim brought by the minor or on the minor's behalf arising out of the minor's participation, including attorneys' fees. The parent or guardian understands that, under California law, a minor may disaffirm this agreement upon reaching the age of majority, and that this indemnity is exactly what is being given in exchange for allowing the minor to take part.

11. Electronic signature

I understand that typing my name and checking the boxes on this form is an electronic signature, and that it carries the same legal weight as a handwritten signature under the federal ESIGN Act and the Uniform Electronic Transactions Act as adopted in California (Cal. Civ. Code § 1633.1 et seq.). I agree that the Gym may store, along with my signature, the exact date and time, the version of the text I signed, my IP address and the browser I signed from, as proof.

12. Governing law and entire agreement

This agreement is governed by the laws of the State of California, and any dispute will be resolved in the courts of San Diego County. If a court strikes any part of it, the rest remains in force. This document replaces any earlier verbal agreement on the same subject.
